1. DEFINITION OF TERMS

CLIENT - Any natural person over 18 years of age who has or obtains access to CONTENT, by any means of communication made available by S.C. STARTOOLS SRL.

REQUEST FOR QUOTE - An electronic document that acts as a form of communication and negotiation between the seller and the client, through which the client sends the seller a request for a price offer or other type of offer via the website. A request for quote can be submitted by completing the form available in the contact section or you can also find the email office@startools.ro or phone number 0765501580 in the respective section.

CAMPAIGN – the action of commercially displaying a number of products and/or services with a limited and predefined stock, for a limited period of time set by the seller.

REVIEW – a written evaluation by the client based on their personal experience and ability to provide qualitative comments and to state whether the product or service meets the mentioned specifications.

RATING – a way of expressing a Client/Buyer's degree of satisfaction with a product.

The rating is expressed in stars, with each product being able to receive a score from one star to five stars.

This degree of satisfaction will always be associated with the review written by the Client/Buyer about a product.

COMMENT – an appreciation or observation with a critical purpose, regarding a Review or another comment.

All products benefiting from a warranty are accompanied by the original warranty certificate issued by the Manufacturer, and the warranty is valid based on the purchase invoice.

The maximum value of damages that can be paid by the Seller to any customer in case of non-delivery or improper delivery is the value of the amount collected by the Seller from this customer. All promotions displayed and described on the site are valid only under the conditions described when the promotion was announced and while stocks last.

5. LIMITATION OF LIABILITY FOR PRICES

The prices presented include VAT and do NOT include delivery costs, with a minimum order of 1000 RON + VAT

The Seller reserves the right to change the price for products brought to order.

The price of products brought to order may be influenced by the exchange rate or other taxes and duties.

6. DELIVERY INFORMATION

After placing an order on the website https://startools.ro/, you will receive a confirmation email. We deliver throughout Romania, using couriers such as Cargus, DPD, Fan Courier, depending on availability.

Ordered products will be delivered within 2 – 30 working days, depending on available stock. Before delivery, we ensure that products are properly and safely packaged.

When you receive the package, please check if the packaging is damaged. If you notice such problems, refuse the product and fill out a Damage Report together with the courier.
The shipping fee is 35 lei. The shipping fee may vary depending on the size and weight of the package, as well as the distance traveled. There is also an additional fee of 2 lei/kg for extra weight. If we deliver to a locality not covered by the courier, an additional fee may apply. If this fee applies and you were not notified at the time of placing the order, you will be contacted by phone.

When the package arrives, please sign the receipt document and pay the value of the goods. After that, you can unseal the package and check the product. If you are a natural person, you have the right to return the products within 14 calendar days after purchase.
Ownership of the goods transfers to you upon payment by bank transfer or card, or upon signing the shipping document and making payment, in the case of cash-on-delivery shipments.

Orders placed before 13:00 can be processed on the same working day. We strive to deliver products as quickly as possible after order completion. Any delays or delivery issues will be communicated by phone by our operators.

7. LIMITATION OF LIABILITY FOR DELIVERY

Product delivery has a national coverage area and will therefore be made anywhere in Romania.

The Seller reserves the right to confirm orders before fulfilling them through online confirmation (by the client) or by phone confirmation.

Shipping costs will be borne by the buyer.

The Seller reserves the right to delay or cancel deliveries of ordered products if they cannot be fulfilled due to reasons independent of the Seller.

Cases may include: calamities, fires, explosions, floods, epidemics, strikes, governmental actions, wars, acts of terrorism, protests, riots, civil unrest or other impediments of force majeure, according to the provisions of Romanian law.

Before each delivery, the client will be contacted by the courier company representative. If the client is not found at the mentioned address, within the agreed time interval, the courier will return once more after re-establishing contact with the client. Orders will be taken and managed between 08:00 - 17:00, except in situations where there are too many orders, in which case orders will be processed in chronological order.

If the package is not picked up, the order will be canceled and the product returned to the Seller's premises.

The client would then bear the costs of both a new delivery and the costs of the unfulfilled delivery, regardless of the value of the ordered products.

After canceling a card transaction, the issuing bank will unblock the amount held in the client's account within 1-30 days, depending on its policy.

7.1 Free Shipping for Certain Orders

STARTOOLS SRL offers free shipping for orders over 1000 lei + VAT in Bucharest, provided that payment is made by card at the company's premises or by bank transfer (OP). This offer is applicable only to orders that meet both conditions: a minimum value of 1000 lei + VAT and the payment method (card or OP).

Please note that some product categories are not eligible for free shipping, even if the total order exceeds 1000 lei + VAT and payment is made by card or OP. These exceptions will be clearly marked on the product page. If your order includes both products eligible for free shipping and products that are not eligible, the shipping fee will apply only to the ineligible products.

8. CUSTOMER OBLIGATIONS FOR GIFT PRODUCTS

Products delivered by the Seller as a "gift" are offered as a method of rewarding the client for placing an order on the Seller's website.

The Client acknowledges and agrees that the product offered by the Seller as a "gift" represents a determining reason for placing an order on the Seller's website.

The client undertakes that, should they wish to return the purchased product, they must also return the "gift" product in the condition in which it was received. If the client returns the purchased product and wishes a refund, but does not return the "gift" product, the Seller is entitled to withhold from the refunded amount the value of the "gift" product at the value displayed on the purchase invoice.
Gifts may differ from those chosen in the order and are granted while stocks last.

9. PAYMENT METHODS

Payment for ordered products can be made by bank transfer or upon delivery of the products – CASH ON DELIVERY.

The Seller reserves the right in certain cases to request advance payment for products.

Advance payment can be made by bank transfer, and proof of payment must be sent to the Seller at the email address office@startools.ro, but before paying by bank transfer, you must contact the company representative.

Delivery will be made only after the money has been received in the Seller's account.

Other payment methods: Online with a bank card through the solution (intermediary, partner) plationline.ro (Visa / Maestro / Mastercard).

If you have chosen the "Online, by bank card" payment method, you need to complete a form with your card information on the secure page of the payment processor.

Payment in installments via LeanPay

Our store's customers can opt for fast and secure installment payments through the LeanPay service. This payment method allows the purchase of desired products in several fixed monthly installments, without the need for a credit card.

The process is simple and completely digital:

10. LIMITATION OF LIABILITY FOR PAYMENT

Online payment can be made with your personal or company card, in complete safety.
Accepted cards for payment are those issued under the VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV2/CVC2 code) logos.

Regardless of the currency you have in your account, transactions are made in RON, at your bank's exchange rate. Payment for ordered products can be made by bank transfer or upon delivery of the products – CASH ON DELIVERY.

The Seller reserves the right, in certain cases, to request advance payment for the products.

13. RETURN AND REFUND POLICY

Products purchased remotely can be returned according to G.E.O. 34/2014. According to current Romanian legislation (OUG 34/2014), the legal right of return within 14 days applies exclusively to consumers (individuals). Legal entities (companies) do not benefit from this legal right of withdrawal.

The consumer has the right to withdraw from the purchase, without penalties, within 14 calendar days from the day on which you or a third party, other than the carrier, indicated by you, acquires physical possession of the products.

Product returns are possible within 14 calendar days from the termination of the contract, and transport will be borne by the buyer.

Products that can be returned from these categories must not show signs of wear, interventions of any kind on any element of the product, or blows, scratches.

The merchant reserves the right to refuse a product if it shows signs of wear or blows, scratches, or modifications of any kind.

The refund for returned products will be made as soon as possible after receiving the products, provided the customer provides the necessary payment information.

The refund of due amounts will be made by bank transfer to the customer's account or for orders paid by card, the amount will be returned to the same card used for the transaction, within a maximum of 14 days from the acceptance of the return.

In the situation mentioned above, the customer will return the purchased product, using the same transport service with which the delivery was made, within the stipulated term, in its original packaging, without showing any signs of damage or wear.

Shipping costs will be borne by the buyer.

Please keep proof of shipment of the returned package until the analysis process of any complaint is completed, and in the case of returned goods, until the money is refunded.

To be accepted, returned products must be in their original condition. They must not have been used and must not show signs of wear, scratches, blows, cracks, or unauthorized interventions on any element of the product.

COMPLAINTS
This procedure regulates the process of resolving complaints received from end-users, individual or legal entity customers of S.C. STARTOOLS S.R.L., who benefit from services through a contract.

A complaint is a request from end-users to resolve situations they consider to be deviations from the legal or contractual conditions for service provision, for which a response or resolution is expected.

DEADLINES
Deadline for submitting complaints and service disruptions: complaints can be submitted at any time, without a "maximum" deadline;

Information deadline: If other deadlines have not been negotiated in the contracts concluded between S.C. STARTOOLS S.R.L. and the end-user, the user will be informed of the outcome of their complaint at the time of its resolution. If the complaint is not resolved within the stipulated period, the user will be informed of the outcome of the complaint at any time, upon request and at the initiative of S.C. STARTOOLS S.R.L., weekly;

Maximum deadline for resolving complaints and service disruptions: If other deadlines have not been negotiated in the contracts concluded between S.C. STARTOOLS S.R.L. and the end-user, the resolution of complaints and the sending of the response to the end-user will be carried out within a maximum of 30 days. If the complaint cannot be resolved within the stated period due to the complexity of the connection solution, the specific requirements of the user, and the nature of incidents that may occur, S.C. STARTOOLS S.R.L. will inform the end-user about the status of the resolution and the new resolution deadline.

METHOD OF HANDLING COMPLAINTS OR SERVICE DISRUPTIONS
The end-user will be informed of the outcome or status of the steps taken to resolve their complaint, using the same method they used to submit the complaint. Upon receipt of the complaint, a ticket with identifying data will be issued. After the complaint is taken over by a representative, the customer is contacted by phone at the number provided in the complaint for any additional details. After the complaint is resolved, the customer will be informed of the resolution, and the opened ticket will be closed.

DISPUTE RESOLUTION
In the event of disputes, an amicable settlement will be attempted, and if this procedure fails, users can resort to any other extrajudicial procedures or address the competent courts.
